Overview

Welcome to acendsion.com. The terms "we," "us," and "our" refer to Acendsion, a Sweden-based business that operates this online store. The terms "you" and "your" refer to the customer or visitor.

Acendsion sells skincare, supplements, and digital products exclusively to customers in the United States. The Services include this website and all related information, content, features, tools, products, and services provided by Acendsion (the "Services"). The Services are powered by Shopify.

These Terms of Service ("Terms"), together with our Privacy Policy and Returns & Refunds Policy, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, dispute resolution, and the laws that govern our relationship.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

Section 1 — Service Area and Eligibility

Service Area. The Services are intended for customers located in the United States only. We do not market to, ship to, or accept orders from customers outside the United States. If you place an order from outside the United States, we reserve the right to cancel it and issue a full refund.

Eligibility. By using the Services, you represent and warrant that:

- You are at least 18 years of age

- You have the legal capacity to enter into a binding agreement

- You are accessing the Services from within the United States

- All information you provide is accurate, current, and complete

- Your use of the Services will comply with these Terms and all applicable laws

We do not knowingly allow individuals under 18 years of age to use the Services or make purchases.

Section 2 — Account Security

If you create an account on the Services, you are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to:

- Provide accurate, current, and complete information when creating your account

- Promptly update your account information when it changes

- Maintain the security and confidentiality of your password

- Notify us immediately at acendsion@gmail.com if you suspect any unauthorized access to your account

You may not transfer, sell, assign, or license your account to any other person.

Section 3 — Our Products

We make every effort to display our products accurately. However, we cannot guarantee that the colors, appearance, or other characteristics of products shown on your screen will exactly match the actual product, due to variations in device displays and settings.

All product descriptions, prices, and availability are subject to change at any time without notice. We reserve the right to:

- Modify or discontinue any product at any time

- Limit the quantities of any product sold to any person, household, or geographic area

- Refuse service to any customer at our discretion

Important note about our products: Our dietary supplements (Liver Support, Probiotic with Prebiotics, Creatine Monohydrate, Chocolate Whey Protein Isolate, Fruit Punch Pre-Workout, Male Hormone Support, and Complete Multivitamin) are governed by the Dietary Supplement Health and Education Act of 1994 (DSHEA). Statements about our supplements have not been evaluated by the U.S. Food and Drug Administration. Our supplements are not intended to diagnose, treat, cure, or prevent any disease.

Our skincare products (Peptide Face Serum, Peptide Hair Growth Serum, Dark Spot Serum, and Peptide Eye-Gel Cream) are cosmetics regulated under the Federal Food, Drug, and Cosmetic Act and the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). They are intended for external use only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult a qualified healthcare professional before starting any new supplement or skincare regimen, especially if you have a medical condition, are taking medications, are pregnant or nursing, or are otherwise at risk.

Section 4 — Orders and Order Acceptance

When you place an order through the Services, you are making an offer to purchase the selected products subject to these Terms.

Order acceptance. Your order is not accepted until we send you an order confirmation email. We reserve the right to accept, decline, or cancel any order at our discretion, including in the following circumstances:

- The product is unavailable or out of stock

- We detect a pricing or product description error

- We are unable to verify the payment method or shipping address

- We suspect fraud, abuse, or violation of these Terms

- The order is placed from outside our service area

If we cancel an order after acceptance, we will refund any amounts charged. We will attempt to notify you using the contact information provided at the time of the order.

Personal use only. You represent and warrant that your purchases are for your personal or household use, not for commercial resale, redistribution, or export.

Section 5 — Pricing, Payment, and Billing

Prices. All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will appear in your order confirmation email. Posted prices do not include applicable taxes, shipping, or handling charges, which will be added at checkout.

Payment. By providing a payment method, you represent and warrant that:

- The payment information you provide is true, accurate, and complete

- You are authorized to use the payment method

- Charges incurred by you will be honored by your card issuer or financial institution

- You will pay all charges, including applicable taxes and shipping charges, at the prices in effect when incurred

We use third-party payment processors (including Shopify Payments) to process payments. We do not store your full payment card details on our systems.

Promotions. We may offer promotions, discounts, or special pricing from time to time. Any such promotions are subject to their own terms, which will govern in case of conflict with these Terms.

Section 6 — Subscription Orders (Auto-Renewal)

If you sign up for a subscription, the following additional terms apply, in addition to the disclosures presented at checkout:

- You authorize us to charge your payment method automatically at the recurring interval you selected (typically every 30 days) until you cancel

- Your subscription will continue until you cancel it

- You will receive an email reminder before each renewal

- You may cancel at any time through your customer account or by emailing acendsion@gmail.com

- Cancellation must be requested at least 24 hours before your next scheduled shipment to prevent the next charge

- Charges already processed cannot be reversed except as required by law

These terms are designed to comply with the Restore Online Shoppers' Confidence Act (ROSCA, 15 U.S.C. § 8401 et seq.) and applicable state automatic renewal laws, including the California Automatic Renewal Law (Cal. Section 7 — Shipping and Delivery

We use third-party fulfillment partners, including Supliful for supplement orders, to ship products to you. We are not liable for shipping delays, including delays caused by carriers, weather, customs (where applicable), or other events outside our control.

All delivery times shown on the Services are estimates only and are not guaranteed. Title and risk of loss for ordered products pass to you when the products are transferred to the carrier.

Section 8 — Returns and Refunds

All returns, refunds, and order cancellations are governed by our Returns & Refunds Policy, which is incorporated into these Terms by reference.

Section 9 — Digital Products

Digital products such as THE CODE and any other downloadable protocols, guides, or content sold on the Services are subject to the following additional terms:

- Digital products are provided for your personal, non-commercial use only

- You may not redistribute, share, resell, or publicly display digital products without our express written permission

- Digital products are provided "as is" for educational and informational purposes only

- Digital products are non-refundable once delivery has commenced (see Returns & Refunds Policy)

Disclaimer for digital products: Digital products such as THE CODE provide general information about lifestyle, fitness, nutrition, skincare, and personal development. They are not medical, psychological, dietetic, or other professional advice. Before applying any of the recommendations in our digital products, especially if you have a medical or mental health condition, are taking medications, or are at risk for any condition, consult a qualified licensed professional. We make no guarantee of any specific outcome from using our digital products.

Section 10 — Intellectual Property

The Services, including all trademarks, logos, brand names, text, images, graphics, video, audio, design, and arrangement, are owned by Acendsion or its licensors and are protected by U.S. and international intellectual property laws.

Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms.

You may not:

- Reproduce, distribute, modify, or create derivative works of any content on the Services without our prior written consent

- Use any of our trademarks, logos, or brand names without our prior written permission

- Use automated tools to scrape, copy, or extract content from the Services

All rights not expressly granted are reserved.

Unauthorized use of our intellectual property may result in legal action under federal and state law.

Section 11 — Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services:

- For any unlawful purpose or in violation of any applicable law

- To infringe upon any intellectual property rights or other rights of any party

- To harass, abuse, threaten, defame, or harm any person

- To transmit false, misleading, or fraudulent information

- To send unsolicited advertising, spam, or chain communications

- To impersonate any person or entity

- To upload or transmit viruses, malware, or other malicious code

- To attempt to gain unauthorized access to any portion of the Services

- To interfere with or disrupt the Services or any servers or networks connected to the Services

- To collect personal information about other users of the Services

- To resell, duplicate, or commercially exploit any portion of the Services

- To use any robot, spider, scraper, or automated means to access the Services, except as permitted under Section 12

We reserve the right to suspend, restrict, or terminate your access to the Services at any time, without notice, if we believe you have violated these Terms.

Section 12 — Automated Agents

This section applies if you use, deploy, or cause the deployment of an automated agent (including AI assistants or "agentic AI") to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person.

Agents may access the Services only if they:

- Identify themselves clearly in all HTTP/HTTPS requests by including "Agent/[agent name]" in the request's user-agent string

- Do not conceal or obfuscate that they are an automated agent (e.g., by mimicking human behavior or bypassing CAPTCHAs)

- Respond truthfully to any prompt seeking to determine whether interactions are coming from a human or an automated system

- Comply with any technical measures we use to limit, manage, or block automated access

- Comply with all other provisions of these Terms

We may impose technical or other restrictions on Agent access to the Services at any time.

Section 13 — User-Submitted Content and Feedback

If you submit, post, or transmit any content to us — including reviews, feedback, suggestions, comments, or other materials ("User Content") — you grant Acendsion a perpetual, worldwide, royalty-free, sublicensable, non-exclusive license to use, reproduce, modify, adapt, publish, distribute, and display the User Content in any medium for any lawful purpose, including marketing and operating the Services.

You represent and warrant that:

- You own or have all necessary rights to the User Content

- The User Content does not infringe any third party's rights, including intellectual property, privacy, or publicity rights

- The User Content is truthful and based on your genuine experience

- You have disclosed any compensation, free products, or other incentives you received in connection with the User Content, in compliance with the FTC Endorsement Guides (16 C.F.R. Part 255)

- The User Content does not contain unlawful, defamatory, threatening, obscene, harassing, or otherwise objectionable material

- The User Content does not contain malware or other harmful code

We are under no obligation to publish, retain, or respond to your User Content. We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion.

You are solely responsible for your User Content. We assume no liability for User Content posted by you or any third party.

Section 14 — Third-Party Services and Links

The Services may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, accuracy, privacy practices, or actions of any third party.

If you choose to access third-party websites or services through the Services, you do so at your own risk. We encourage you to review the terms and privacy policies of any third-party services before using them.

Section 15 — Relationship with Shopify and Supliful

Shopify. The Services are hosted by Shopify Inc. While Shopify enables us to provide the Services to you, all sales and purchases are made directly with Acendsion. By using the Services, you acknowledge that Shopify is not responsible for any aspect of your transaction with us, including any injury, damage, or loss arising from your purchase or use of products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with Acendsion.

Supliful. Supplement products sold on the Services are fulfilled through Supliful, our third-party manufacturing and fulfillment partner. While Supliful manufactures and ships these products, your contract for purchase is with Acendsion.

Section 16 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping, availability, or other matters. We reserve the right to correct any errors and to update or change information (including after you have submitted an order) without prior notice.

If we discover a material error in pricing or product information after you have placed an order, we will contact you and offer the option to either confirm the order at the corrected price or cancel the order for a full refund.

Section 17 — Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACENDSION DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

- THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

- THE RESULTS OBTAINED FROM USING THE SERVICES OR PRODUCTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

- ANY ERRORS OR DEFECTS WILL BE CORRECTED

INFORMATION PROVIDED ON THE SERVICES, INCLUDING ABOUT OUR PRODUCTS, IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND IS NOT MEDICAL, LEGAL, OR PROFESSIONAL ADVICE. ANY RELIANCE ON SUCH INFORMATION IS AT YOUR OWN RISK.

SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS ANY WARRANTIES THAT CANNOT BE LAWFULLY DISCLAIMED.

Section 18 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ACENDSION OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS, OR THOSE OF SHOPIFY OR SUPLIFUL, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACENDSION IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.

SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Section 19 — Indemnification

You agree to indemnify, defend, and hold harmless Acendsion, its affiliates, officers, directors, employees, agents, and partners (including Shopify and Supliful) from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

- Your breach of these Terms or any policy incorporated by reference

- Your violation of any law or any third party's rights

- Your use of the Services

- Your User Content

We will notify you of any claim subject to indemnification and may, at our option, control the defense and settlement of the claim. You will cooperate with our defense.

Section 20 — Termination

We may suspend or terminate your access to the Services, or any part of them, at any time, with or without notice, for any reason, including violation of these Terms.

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination — including Sections 10 (Intellectual Property), 13 (User Content), 17 (Disclaimer of Warranties), 18 (Limitation of Liability), 19 (Indemnification), 20 (Termination), 22 (Dispute Resolution), 23 (Governing Law), and 25 (General Provisions) — will survive.

Section 21 — Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make changes, we will post the updated Terms on this page and update the "Last updated" date.

For material changes, we may also notify you by email or through a notice on the Services. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Services.

Section 22 — Dispute Resolution

Informal resolution. Before filing a formal claim, we encourage you to contact us at acendsion@gmail.com. Most issues can be resolved quickly through direct communication.

Governing law. These Terms and any dispute arising out of or related to these Terms or the Services are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles, except where preempted by federal law.

This choice of law does not deprive you of the protection afforded by the mandatory laws of the U.S. state where you reside, including consumer protection laws that cannot be waived by contract.

Forum. Subject to the informal resolution process above, you and Acendsion agree that any legal action arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, United States, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

You consent to the jurisdiction of and venue in such courts.

Class action waiver. You and Acendsion agree that any dispute will be brought on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator (if applicable) or court may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

This class action waiver does not apply where prohibited by applicable law.

Statute of limitations. Any claim arising out of or related to these Terms or the Services must be brought within one (1) year after the cause of action accrues, or such longer period as required by applicable law. After that period, the claim is permanently barred.

Section 23 — General Provisions

Severability. If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force.

No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Entire agreement. These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and Acendsion regarding the Services and supersede all prior agreements.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign or transfer these Terms without restriction.

No agency. No agency, partnership, joint venture, or employment relationship is created by these Terms.

Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, pandemics, internet outages, or supply chain disruptions.

Section 24 — Consumer Rights and Reporting

Nothing in these Terms limits or waives your rights under U.S. federal or state consumer protection laws.

If you have a complaint that we cannot resolve, you may file a complaint with:

- The U.S. Federal Trade Commission at reportfraud.ftc.gov

- Your state's attorney general or consumer protection authority

- Your state's consumer protection agency (for state-specific concerns)
